Norbert Klein, the editor of the Mirror, voiced his reaction to the news published by Khmerization on “Thai troop crossed into Cambodia at Phnom Trop” by weighting heavily on the Joint Communique (JC) 2008 signed by Sok An and Nopapdon Patama that the crossing areas at Phnom Trop do not belong to Cambodia according to the JC 2008. Below is his complet reaction:
There are again confrontations at the border – west of Preah Vihear. This is dangerous, deplorable, it has to be defused, avoided in future.
But I continue to be surprised, time and again, that the Joint Communique of 18 June 2008, including the map produced by the Cambodian side, and the declaration of the Cambodian side is never referenced in such Cambodian reports.

In some mail exchanges before, I have been accused to disregard documents of 1904/1907/1962/2000 – this is not what I said; I just point to the fact that there is a document signed later, by a Deputy Prime Minister of the Kingdom of Cambodia, saying that the 18.6.2008 map “supersedes” the former maps “at this stage.” – And the Thai troops, mentioned in the present posting, are in “territories at the foot of Phnom Trop Mountain west of the Preah Vihear temple” – where the Cambodian side said, at that time, that “a buffer zone on the northern and western areas of the Temple” is not part of the Cambodian claims when applying for World Heritage listing.
I am not a legal expert, I am not “taking sides” – I just share my observation that there is never an official clarification how the 18.6.2008 Cambodian map and declarations relate to the ongoing conflict, and how the Cambodian side in the present and future border discussions intends to handle the Cambodian statements in the Joint Declaration. Just to say “forget it” is not appropriate for a document signed by a Deputy Prime Minister.

As a response to Norbert Klein I have already written my reacted comment in Khmerization on Preah Vihear: Khmerization vs Norbert Klein, on 9 Frebruary 2009. And below is just my sum-up because I think this a very important issue and every one should clearly understand about this very sensitive conflict.
- Norbert Klein is so bais and not a real observer as he claimed.
- Norbert Klein should have carefully read the verdict of ICJ 1962, the MOU 2000, and the JC 2008 as well as other statements of Thai government related to how the conflicts to be solved before giving his self-centered judgement.
- The JC 2008 is not a map of border lines between the two countries but it is just drawn in the purpose to prescribe the Preah Vihear temple as the World Heritage site only ( actually it is completely wrong for Cambodia to draw this map) and it has no affect on the verdict of ICJ 1962 and the 1904-1907 Siamese-French Treaty. And this is clearly justifiedly that the Preah Vihear temple is listed even though Thailand withdrew its support of the JC 2008.
- Norbert Klein should not mention the JC 2008 as a reference in order to reject the legitimate ownership of Phnom Trop of Cambodia either because the JC 2008 is legally invalid for any future reference due to the Thai adminstration court´s injunction on 26 June 2008 and the Thai Constitutional Court´s annulment on 08 July 2008.
So we should not talk about the JC 2008 anymore because it is already closed. And Norbert Klein please stop messing up the conflict!

A very good argument. One must not weigh too heavily on the 2008 Joint Communique for Khmer-Thai border resolutions because the Thai side has reneged on this agreement and the Thai constitutional court has also annulled it a few days before the Unesco listing of the temple. So, the 2008 JC has become a dead or invalid document. The 1904 treaty, the 1962 ICJ verdict must be the based documents for border resolutions because they are internationally-recognised documents. Congratulation!

Norbert Klein must be a Thai-western espionage or a western vagrant who has so much time to intervene the Southeast Asian affairs. Your essays are prevaricated about JC2008 and biased to Cambodia convey that you must be hypocritically disguised as placid western observer. Your assumption should never be a prescience which bases on quixotic, instead, if you are skeptical about any Cambodian contemporary politics, you should invest more times to learn either in Phnom Penh or Pailin. Premeditatedly written on a false statement of mediation of Cambodian politics is odious and noisome. To the nadir regardless of who you are, you are miscreant from the perspective of the Khmer people. You obviously should know that Khmer government, soldiers are fearless of M-16 and western weaponry. Whether you try to excoriate Khmer people is harmless to me. Your words and philosophical aims at Cambodian’s vicinity of Preah Vihear are covetous.

I am not surprised to see Nobert Klein from the British Mirror acts so clueless about Cambodia Preah Vihear. Since the current Thai PM was born in UK and educated in UK, I guess Nobert Klein has to protect the Thai interest to protect a British Thai born in UK.
