Thailand fitted in the category B of War Crimes Statute

Sent to Khmerization by an anonymous reader.The draft statute of international laws enumerates four different categories of war crimes. The first two categories apply to international armed conflicts and are largely based on well-established principles of international law. Here is brief support for Category B:

B. Other serious violations of the laws and customs applicable in international armed conflicts , these provisions are derived largely from the Hague law.

- targeting civilians;(Thailand targeting Cambodian civilian in the Feb and april clashed )
- targeting buildings devoted to art or science; (Thailand targeted Preah Vihear Temple on 04/02/2011 clashed)

The use of particular weapons(Thailand used cluster bombs in the Feb and April 2011 clashed against Cambodia), such as poison or poisoned weapons, gas weapons, (Thailand used poison or poisoned weapons in the Feb and April 2011 clashed against Cambodia), chemical weapons and bacteriological weapons; also constituting a grave breach of the Geneva Conventions.

The long arms of the international laws will catch up with Thailand soon if Thailand still acting ruthlessly against Cambodia .

[Thai] PM ready to confer with Hun Sen under JBC framework [-Abhisit's conditions will likely be rejected by Cambodia?]

BANGKOK, June 5 (MCOT online news) – Thai Prime Minister Abhisit Vejjajiva said Sunday that he is prepared to discuss with his Cambodian counterpart Hun Sen on ways to end the two countries’ border tensions.

Mr Abhisit noted talks can start on under the conditions that: discussions must be held under the Thai-Cambodian Joint Boundary Commission (JBC) framework, a joint management plan for the disputed area near Preah Vihear temple must be made, and that Cambodia must also withdraw the temple from world heritage listing.
The Phnom Penh government must also display its sincerity by withdrawing its case handed to the International Court of Justice (ICJ) to interpret its 1962 ruling on the ancient temple before talks can start, Mr Abhisit said.
His remarks were made after a close aide to Thailand’s ex-prime minister Gen Chavalit Yongchaiyudh reportedly said that the latter had recently held talks with Mr Hun Sen in which both men agreed that forces of the two countries posted at the disputed 4.6-square-kilometre patch of land near the cliff-top Preah Vihear temple must be withdrawn and the area would be jointly managed thereafter while boundary demarcation would be handled by JBC members.

It must be understood that the Memorandum of Understanding (MoU) signed between the two countries in 2000 clearly stipulated that changes in the disputed area could not be made by either country, which means that Cambodians must leave the area first if the Phnom Penh government respects the MoU, Mr Abhisit said

“It was politically motivated, and the Sam Rainsy Party will follow up closely and request that the authorities find the real murderers.”
Kandal provincial police have arrested a 28-year-old man on suspicion of killing a popular opposition activist earlier this week.
Police say they arrested Lim Veasna, a father of two in Kien Svay district, Thursday evening with traces of blood on his clothes, and said they had suspected him because he belongs to a group of drug users.
They are still looking for two more suspects and are assuming a motive of robbery in the Wednesday killing of Ouk Chhan, 64, a Sam Rainsy Party activist and likely candidate commune council in 2012.
But Sam Rainsy Party officials said Friday they believe the true killer or killers remain at large.

“It was politically motivated, and the Sam Rainsy Party will follow up closely and request that the authorities find the real murderers,” said Chan Cheng, an opposition lawmaker for Kandal province.
Eav Sam Roeun, chief of Kandal police, said an investigation was ongoing. “We are searching for two more, to show and reply to the political allegations”, he said.
Am Sam Ath, lead investigator for the rights group Licadho, said the murder could have been a coincidence and a robbery. “We will continue to investigate and to verify,” he said.

The murder occurred during a fact-finding visit by the UN’s rights envoy to Cambodia, Suriya Subedi, who declined to comment on the killing without further investigation.

MOU 2000 must be revoked for the sake of Cambodia

If we remember in November 2009 with its overeaction against Cambodia, the Thai government has unilaterally decided to terminate the Memorandum of Understanding (MOU) 2001 with Cambodia on Cambodia-Thailand Agreement for common exploitation of hydrocarbons. Then, I also wrote an article to welcome this termination seeing that this revocation will benefit Cambodia more than loss for future negotiation regarding to Cambodian maritime (http://ki-media.blogspot.com/2009/11/welcome-to-siams-termination-of-2001.html ).

I aslo recomended the Cambodian govt , as response to this unlateral act of Thailand and for the best interests of Cambodia, to unilaterally revoke the MOU 2000. But my voice is not heard and listened to. The problem is that this MOU 2000 has:
1. blocked Cambodian move to proceed its plan for Prasat Preah Vihear managment plan on time,
2. obstructed all borderline demarcations and negotiations with Thlailand if it is to be conducted in accordance with the 1904-1907 Siamese -French treaties which Thailand considers as a loss.
3. used as an alibi to invade Cambodia any time it wants and to distract its internal unrests and keep Cambodian as its political scapgoat for a long term game.
4. used as the legal instrument to justify its aggressive act against Cambodian to international community.

So I again wish that s thMOU 2000 removed for the sake of our country

Thailand points out Cambodia accepted its compliance with ICJ Judgment of 1962; boundary line of whole stretch remains to be demarcated through negotiations
On 30 May 2011 from 16.00-18.00 hrs., the Thai legal team pleaded before the International Court of Justice (ICJ) in The Hague on the first day of the oral hearings on Cambodia’s request submitted on 28 April 2011 for indication of provisional measures, pending the Court’s consideration of the request for the interpretation of its 1962 judgment in the case concerning the Temple of Phra Viharn.

Kem Sokha: Let lightning strikes me if I am a CPP puppet

Following the revelation of the taped conversation between Kem Sokha, HRP president, and Hun Xen which led the public to believe that the HRP was formed by the ruling CPP party, Kem Sokha confirmed that he is clean man and that he is willing to take an oath so that lightning would strike him if he is indeed a CPP puppet.
Kem Sokha declared in front of national news media that he and the HRP are not CPP puppets, and the HRP was not formed to serve the CPP or Hun Xen. “If we are superstitious, let lightning strike me and destroy me if I am bad person as I am accused. Let lightning strike me.
Kem Sokha said that the leak of the taped conversation between him and Hun Xen was done by the CPP to break the democratic voice.
Nevertheless, yesterday, the SRP office issued a statement condemning Kem Sokha’s betrayal, and the SRP stated that Hun Xen and Kem Sokha showed their common goal of destroying the SRP.

No Improvement in Corruption combat under Hun Sen´s leadership

In corruption index 2009 Cambodia was ranked 158 of 180 countries with score 2.0 and in 2010 Cambodia was ranked 154 of 178 countries with score 2.1. Seeing the score Cambodia recieved can we say there is any improvement regarding to Cambodian govt´s commitment to fight against corruption even though is has established an Anti-Corruption Unit?

We see in the Corruption index 2009 it listed 180 countries but in Corruption Index 2010 it listed only 178 countries which to my thinking Cambodia situation may not improved to that ranked or its score added (0.1) may not increased according to govt performance.

As I said the Anti-Corruption Unit created is just a show coz it will help nothing but to hide and secure those stooges in power to commit more crime on corruption.

Thailand does accept the annex 1 map

Thank you for forwarding the article of acharn Anan Krudphet. It is interesting and basically factually correct; his argument is basically the same as that of Archarn Charnvit Kasetsiri’s, see attached, — that the Thailand had accepted the map, the line on the map and the 1904, 1907 treaties. It was PM Pibul Sangream who revised it.
 
In 1939, (onset of of WWII when Thailand wanted to harass French/france in cambodia) it was Vichetr Watkorn (che Leng) who noted the inconsistencies between the definition of the 1904 treaty’s provision  and the line as indicated on the map (the Dangrek (Preah Vihear) Section map) and used or promoted it as the pretext.
 
of note, in 1930, when Prince Damrong, (who was the Minister of Interior and who had been involved in the 1904/1907 treaty/maps negotiations and who accepted the maps from the French),  visited PV temple, he did seek french permission to enter the Temple/the khmer territory as pointed out by Dr. Charnvit here. becaue he knew that the temple was cambodia’s. The Prince was a Suprem Counselor to King Chulalongkara (Rama V) and held the title of Api Ratmuntri (Senior Minister); he was not simply a president of a private society as claimed by the Thai authorities/party in the ICJ proceedings 1961 and 2011.

An open letter to Mr. Hun Xen

Hello Mr. PM Hun Sen and Khmer brothers and sisters. I’m one of Khmers krom, but I’m not living in Cambodia either in Kampuchea krom. Actually, I came to the United States for thirty years ago. I’m writing this letter to you PM Hun Sen because I have been admiring and supporting you from the bottom of my heart. Compared to a several previous generation, you are a good leader. However, I’m sure that you might-have-been remembered what happened before 1970 when the King of Sihanouk was a chairman at the time. I didn’t mean to make him feel bad about what he did, but I just can’t keep it in my heart forever. Sihanouk mess up the country because he fed alligator (HoChiMinh); he himself also knew what he did. In the last few decades, Cambodia had lost so much land just because of the Khmer Empire. Thai, Vietnamese communist, and Lao tried to take advantage of Khmers King kindness, and stool our land. Now is the 21st Century, the young will not repeat the mistake that the old generation had made in the past. My understanding is, Cambodia government will be allowed to all foreigners who want to live in Cambodia, but they must follow the rule of Government just like other Khmer citizens. Here are several rules that they must be following: 1) they must learn the language, 2) they must be able to fill out of the legal documents, 3) they must joint army and serve just like other Khmers do, 4) if they act against the government then they will sentence to prison for life or death penalty, 4) all of the government documents must be Khmers and English languages only.

I had proved and seen in my own eyes that Yuon Hanoi and Thieu’s regime alleged that they wanted Khmers krom to die, so they were always put Khmers krom in front-line just like Thai did to Khmers Surin. I felt sad and sick in my stomach when I saw Khmers died in irrational way. This is not funny to Cambodian people at all. This is a serious matter that Khmers leader should pay a closer attention. Khmers young generation can do better but depend on a leader.

 My understanding is the Education department of Cambodia must create the flyers and small books, and the comment will be written a brief explanation about the history of Cambodian people and original Geography. It can help Khmers Phnom Pen, Khmers Surin, and Khmers Krom to understand more about Cambodian people and Geography. On the other hand, the Cambodia Government must drop the flyers all over the provinces where the Khmers Surin are living.

Therefore, Cambodia Government must show them respect, welcome, and promise that we were born in the same blood and language. God of Buddhism will bless and bring Khmers Phnom Pen, Khmers Surin, and Khmers Krom together in one Nation and united. I believe that Khmers will defeat the enemies because Khmers are tall, strong, brave, confident, and well trained. God knows Khmers can do it. So please, think about it twice.
