A cousin of Prime Minister Hun Sen was found guilty in absentia of corruption and sentenced to two years in prison yesterdaybut remains free in Phnom Penh as a warrant for her arrest has still not been issued.
Dy Proem, 49, was found guilty of paying a US$200,000 bribe to the former deputy general director of the inspection department at the Ministry of National Assembly-Senate Relations and Inspection, Seng Yean, in connection with a Phnom Penh land dispute in 2008.
Judge Duch Kimsorn told the court that Dy Proem bribed Seng Yean to issue a fake Council of Ministers statement on March 18, 2008, falsely claiming she was the rightful owner of more than 5 hectares of disputed land in Dangkor District’s Kakab Commune.
“Based on proof and witnesses, the court has found that Seng Yean and Dy Proem are guilty,” he said. Duch Kimsorn could not be reached later to explain why no arrest warrants had been issued.

Seng Yean was handed a four-year sentence, also in absentia – though he, too has not been arrested – for accepting the bribe, and was ordered to pay US$40,000 in compensation to the Ministry of National Assembly-Senate Relations and Inspection.
During the trial, both defendants were granted bail and neither was summonsed for questioning, in apparent violation of the 1993 penal code promulgated by the United Nations Transitional Authority in Cambodia
Kao Ty, the lawyer of plaintiff Huoth Sarom, vowed to sue Judge Duch Kimsorn at the Supreme Council of Judges soon, alleging that arrest warrants had never been issued for either of the suspects because of political interference.
“I do not accept the court’s verdicts for Mr Seng Yean and Dy Proem, because it was made with wrong court procedures. I also do not accept their sentences, because they are small – they do not fit their crimes,” he said.
Arrest warrants had not been issued for the pair, he alleged, because of their connections to Prime Minister Hun Sen and the ruling Cambodian People’s Party.
The premier has publicly distanced himself from the case in the past, saying last year that the law “does not think about relatives” and his cousin should be “strongly punished” if guilty.
Sok Sam Oeun, executive director of the Cambodia Defenders Project, said the anti-corruption law technically allowed the court to not issue an arrest warrant for a guilty party, though this was set to change on December 10 when it is set to begin referencing the new penal law.
“If it is a felony, maybe she must be arrested, but there are two ways: [if she is] arrested under detention [a misdemeanor], there is no need to arrest,” he said, adding if an arrest warrant is not issued within five years, Dy Proem’s conviction would be annulled completely.
Panhavuth Long, a project officer at the Cambodia Justice Initiative, said the sentence was surprising given that Pursat provincial prosecutor Top Chan Sereyvuth was found guilty of corruption and imprisoned earlier this year.
“How come they found her guilty of corruption? You charge her and you found her guilty, and then you say that is not applicable because the corruption provision is not applicable – that is very strange,” he said.
Khieu Sophal and Chhiv Theng, the defence lawyers of Seng Yean and Dy Proem, respectively, both failed to attend court for the verdict, but later denied their clients had committed any wrongdoing.
Officials from the Ministry of Justice could not be reached for comment.

Thais ‘refuse to return dead Cambodians’

Thai authorities have refused to give families back the bodies of three Cambodians shot while allegedly logging illegally in Thailand, instead deciding to cremate them, the father of one of the deceased said yesterday.
Police said yesterday three men from Samrong town’s Bansay Reak commune in Oddar Meanchey province were shot one week ago in Thailand.
Chan Try, 62, the father of 32-year-old victim Try Sambo, said when he went to Thailand yesterday to retrieve his dead son, Thai soldiers said they had wanted to burn the body first.
They showed us the picture of the corpse and I could recognise that my son was killed,” he said. “Thai soldiers said they wanted to burn them in Thailand. We want to take the body for cremation in Cambodia and to hold a funeral ceremony.”
His son was shot a week ago after he left for Thailand with his brother-in-law, Mu Son, and two other men, Chan Try said.
A border relations official based at O’Smach International Border Crossing in Oddor Meanchey province, who helped facilitate an agreement for the repatriation of the bodies but declined to be named, said Thai officials had promised to return the bodies yesterday.
“But when we arrived to pick them up, they did not bring them and said wait for few more days,” he said.
Meanwhile, two victims who were shot when Thai troops allegedly opened fire on a group of Cambodians after they discovered them illegally logging in Thai territory on the weekend were hospitalised today.
The men were shot on Saturday and Sunday after crossing into Thailand with an unknown number of others from Trapaing Prasat district’s O’Svay commune in Oddar Meanchey province, police said.
Lim Te, Ou Svay commune police chief, said yesterday one victim, 22-year-old Lim Seiha, had been sent to Anlong Veng hospital after he crossed into Thailand from Tomnuk Aphiwat on Saturday.
“We warned the villagers repeatedly not to log like this, but they never listen to us. It is difficult to stop them because the village borders Thailand,” he said.
One of the group remained missing while another man who was shot in the same area on Sunday was sent to Siem Reap hospital yesterday.
A source close to Thai Ministry of Defence spokesman Thanatip Sawangsaeng said yesterday Thai defence personnel would investigate the incident today.

1970s Cambodian conflict was early test for Singapore (And what Cambodia has learnt from Singapore so far?)

SINGAPORE: Former deputy prime minister Wong Kan Seng said the Cambodian conflict which started in the late 1970s was an early test for Singapore and its foreign service.

Mr Wong was the Foreign Minister from 1988 to early 1994 when the Vietnam-Cambodia war came to an end.

Speaking at the S Rajaratnam lecture on Wednesday, Mr Wong highlighted five key lessons from the conflict.

Mr Wong said it showed the importance of being independent and self-reliant.

Singapore demonstrated to the world that in spite of its size it was prepared to defend its interests even when it was up against major powers like the US and China.

The decades-long conflict also made Singapore realise the necessity of being nimble and pragmatic.

Mr Wong said that Singapore had little choice but to pick up on the changing positions of various players and react accordingly.

He added that another important aspect of being pragmatic is to know when to step back and play a supporting role.

From the conflict, Singapore also gained a better understanding of the respective foreign policies and “modus operandi” of ASEAN members.

Mr Wong said: “Then-US Assistant Secretary of State for East Asia, John Holdridge, had made good on his threat to Foreign Minister S Dhanabalan to take the matter up with then Prime Minister Mr Lee Kuan Yew as apparently going so far as to claim that there would be ‘blood on the floor’ if Singapore did not compromise.

“Mr Dhanabalan stood firm, and Mr Lee Kuan Yew even described Holdridge’s behaviour as ‘amateurish’ to the US Senate.”

In addition, Singapore also learnt how multilateral organisations functioned.

Mr Wong also said the Cambodian conflict also taught Singapore the significance of developing and honing an excellent foreign service.

He stressed that to ensure Singapore is well protected, it has to constantly cultivate its foreign service team with abilities such as staying focused on Singapore’s interests and objectives.

Synopsis: In the morning of 23 November, Hun Xen pushed all 26 SRP MPs to resign rather than just the four who had resigned recently. He said that the resignation of opposition MPs will not block the National Assembly sessions. “I would like to send my words to them: Don’t be dumb, if you want to be crazy, be crazy by yourself, don’t make others be crazy, I will not be crazy with them. There is no way for the minority to force a veto on the majority. The opposition has no veto rights.

Causes of Death

A number of different causes of death were reported after the tragedy, and these have changed over time. Hospitals reported that the primary causes of death were asphyxiation, drowning and internal bleeding. However, witnesses of the event and those injured that night have repeatedly said that some people were electrocuted, possibly due to the lighting on the bridge.

Particularly concerning are the comments from a doctor that CCHR spoke to, who said that doctors within his hospital saw many people who had been electrocuted. However, shortly after this was made public a Military General came to speak to the hospital management, and the doctors were told not to mention death by electrocution. There were also reports that the police sprayed the crowd with water cannons.

ទន្ទឹមនឹងនេះ លោក សម រង្ស៊ី ប្រធាន​គណបក្សនេះ បានថ្លែងពី​ប្រទេសបារាំង តាមរយៈ​វីដេអូខនហ្វឺរិនថា សេចក្តី​សម្រេច​លាលែងរបស់​តំណាងរាស្រ្ត​ទាំងបីរូបនេះ ស្របនឹង​ឆន្ទៈរបស់​តំណាងរាស្រ្ត និងច្បាប់ ហើយបានអះអាងថា គណបក្ស សម រង្ស៊ី ​នឹងមិនដាក់ឈ្មោះ​បេក្ខជន​បន្ទាប់ ដើម្បីជំនួស​អាសនៈ​តំណាងរាស្រ្ត​ទាំង ៣ រូបនេះឡើយ។ លោក ថ្លែងថា​៖ «យើងនឹង​រង់ចាំមើល​សកម្មភាព​របស់​រដ្ឋាភិបាល»។ លោក​បញ្ជាក់ថា៖ «គ្មានអ្នកណា​អាចយកកៅអី​យើងបានទេ​។ ពួកគេអាច​យកកៅអីយើងបាន លុះត្រាតែ​យើង​រំលាយខ្លួនយើង​»។ លោកបន្តថា ការ​លាលែងនេះ​នឹងធ្វើឲ្យ​រដ្ឋាភិបាល មិនអាច​ខ្ចីលុយពី​បរទេសបានឡើយ ដោយអះអាងថា ប្រសិនបើ​រដ្ឋាភិបាល​មិនអាច​ខ្ចីលុយ​ពីសហគមន៍​អន្តរជាតិបាន​ រដ្ឋាភិបាល​នឹងដួល​។

Synopsis: In November of this year, 12,165 illegal Cambodian workers were deported out of Thailand. Each month the number of Cambodian deportees amounts to about 10,000. Not a single goes by without seeing deportation of Cambodian from Thailand. Is this the CPP win-win strategy?

លោកស្រីថា “ថៃនិរទេសពលករខ្មែរ ជាងមួយម៉ឺននាក់ក្នុងមួយខែៗ ដែលនេះបង្ហាញ ពលករខ្មែរត្រូវបាន ថៃនិរទេសចេញ ស្ទើរាល់ថ្ងៃបន្ទាប់ពីបានទៅ ធ្វើការ ដោយខុសច្បាប់”។

លោកស្រីបន្តថា ក្នុងនោះមាន កុមារា៤.២៥៦ នាក់ និងកុមារី ១៦១ នាក់ ដែលឆ្លងដែន ទៅជាមួយឳពុកម្តាយផងដែរ ជាពិសេសទៅទៀតនោះមានកុមារខ្មែរ១៥ នាក់ដែលត្រូវបាន គេជូញដូរពលកម្ម ហើយត្រូវបញ្ជូនត្រលប់មកវិញ។

សូមបញ្ជាក់ថា ប៉ុន្មានខែចុងក្រោយនេះពលករខ្មែរ ដែលធ្វើការនៅតាមរោងចក្រ ភោជនីយដ្ឋាននៅទឹកដីថៃ ត្រូវបានបញ្ជូនមកស្រុកកំណើតយ៉ាងភ្លូតទឹកភ្លូតដី ដោយសំអាងហេតុថាថៃ កំពុងរងគ្រោះដោយទឹកជំនន់។

It is unbelievebale that the tragedy of Koh Pich was ended without having anyone held responsible for it.

It is also unbelieveble that Hun Xen who is known as the strong of Cambodia and everyone who supports him always admires him for the strong leadership in maintaining peace, political stability, and social security couldn´t even protect and secure our people´s lives on the 100 meter-long bridge in the heart of the city and in front of hundreds of pocemen.

We still demand for justice for this tragedy and Hun Xen too must be the one to be brought to trial foR HIS IRRESPONSIBILITY as a leader. He has shown a very bad example through this tragedy by declaring that “No one was to be blamed but the people themselves.”

Press Conference: SRP´s mission to make constitutional crisis

PRESS CONFERENCE ON THE RESIGNATION OF SRP MPs in order to MAKE CONSTITUTIONAL CRISIS as stated by the article 76 of constitution that “The National Assembly consists of at least 120 members.”

The resignation MPs are Ms. Ke Sovannroth, Ms. Thak Lany and Mr. Nuth Rumduol.

It is a great move and has shown a very positive image of our party with both Cambodians and inthernational communities which legitimately put the SRP in the right position to fight against the dictatorship regime.

However, the CPP under Hun xen may resort to other means to solve the issues at wish without abiding to the real spirit of the constitution and the election law such as:

1). CPP has its majority in the NA and Hun xen is the master and it can amend the constitution to solve the crisis just like the political deadlock in 2003-the packack vote.

2). CPP may resort to other threats esp., like using administrative discipline in order to pressure other boycotting SRP members to attend the NA session which can guaranttee its constitutional plot/threat.

3) Other possibility is that CPP may use the bribeable SRP memebers to come out and declare that they will stand for the resigned MPs and aprroved by CPP majority in the NA regardless SRP’s objection.

4. CPP will also look into the amemndment of election law on National Assembly article 120 if the by-election cant be held or if it wants to avoid the by-election.

FOR SRP:
More conditions for this particular mission must be added for negotiation like:

1. National election committee must be reformed (leadership and independecy from MoI)
2. The seats allocation must reformed for the present formula cannot guaranttee the spirit of the voters and it is unfair.(NOTE: if we rememeber the counting system/seat allocation was amended in the middle of National election 1998 in order to favor the CPP for its adoption of the highest everage which is contradictory to UN´s election law on seat allocation which use the greatest remainder system allocates seats in a way that favours small parties. )
3. Searts for NA must be increased in order to fit the increased of the voters and populations in the country.

PS: The present seat allocation departed from the UN-prescribed
proportional representation system in one small but important respect. Instead of the ‘greatest remainder’ formula for dealing with leftover votes, the National Assembly incorporated the ‘highest average’ formula, also known as the Jefferson or d’Hondt formula, in the 1997 Election Law. The ‘highest average’ system favours larger parties, sometimes disproportionately giving them seats at the expense of smaller parties.

“In Cambodia, it is well known that virginity is a business.” - A police officer

Sold as children, as mere commodities, abused, raped, many small Cambodian end up in brothels before dying from AIDS.
“I sold my virginity for $500 to an old man to help my family: that was the only thing of value that we have.” In Cambodia, women have no say in this matter and even less when they are young adolescents. Mostly innocent and ignorant, the poorest of them are snatched from their peaceful countryside by either a relative, a friend or a neighbor under the false promise of a better life, some are kidnapped and drugged before being sold. “The person who betrayed me was a friend. I was to suppose to work in a restaurant for $145 a month. But, I was raped…” She is still dazed: “I called for help but nobody came. I was sold. The client could do anything he wanted with me.” Sometimes the evil deed comes from no other than their own mother: “I was in debt and I was trying to survive. I had to sell my daughter for $300 dollars. Now I’m sorry for her…” Very young girls are commodities like everything else, in this country where people seek to buy virginity because it is endowed with magic powers. “Men think that if they have sex with a virgin, it will whiten their skin and that they will be rejuvenated and will live longer.” “The police and the general public have no idea of what pedophilia is.There is no word in Khmer to describe this scourge!” the head of a NGO lamented. “In Cambodia, there is no equality of the sexes,” an old woman explained. “It is said that if a man misbehaves, he can wash himself off and become clean again. In contrast, women are like a white cloth: if they do something wrong, the fabric will be dirty for the rest of their lives… “ Therefore, a girl who lost her virginity attracts dishonor to her family and becomes a pariah.

They are lovely little girls tortured from the inside and they are struggling to hold back their tears. At 13, Trem carries a sadness inside her that will never go away: “I worked for a year now. My rate depends on the number of sexual relationships I have. Sometimes they have mercy on me because I’m so young.” The men who agreed to talk in this remarkable film by Matthew Watson, displayed an incredible cynicism: “I paid $400 for her virginity for seven days of sex. When we made love for the first time she looked normal, she complained only of pain in her stomach.” “I do not know how much he paid for me. I just know that I stayed locked up with this man for a week, without the right to anything. I had to stay in that room and sleep with him. And even if I could not stop myself from crying, he still wanted to have my virginity.” Youngsters explained calmly, in front of the camera, that when they are in large number, if one of those unfortunate girls does not agree to satisfy them all, then they will be forced to use violence her… The threat of AIDS has further emphasized the search for virginity and it made this business so lucrative that the number of middlemen saw a proliferation: they are seen roaming the countryside in search for young girls. A NGO official explained: “A customer can afford a virgin girl for a week or a month, then he sells her to a brothel. We have many cases of girls who were purchased at 12 or 13 and they find themselves as prostitutes. Their life is over. Most of them end up catching AIDS, and have no future.” Testimonies from these young kids with empty eyes abound. They say, in a weary tone filld with resignation: “These men never think of their own daughters and sisters …”; “I feel empty, worthless. I feel like I am a fish on sale at the market. There were about 700 men who had sex with me this year.” She sits on her bed, stiff, with her long black hair framing her empty eyes: “I know that if I die, it will not be from old age…”
This one girl looks like a child, but her beautiful face only shows an endless exhaustion. She is way beyond her crying stage when she said in her soft voice: “A man wanted to buy my virginity for $1,000, but I declined: I was hoping to keep it for my husband. Finally, it was stolen fro me… If I was born into a wealthy family, I would not do this kind of work, I might have a better future.” She is now crying in her hushed voice. In this country – one of the most corrupt in the world where the cops themselves abuse children – abductions, rapes, murders are on the rise. “One day I was raped by a gang: about 50 men at a time. I fainted three times. They said that they will rape me until I die…” “How to get rid of this scourge?” asked a dumbfounded NGO leader. “I suppose that we will need to change the heart of these men…” One has a hard time forgetting these sacrificed little girls who are devastated, whose dignity has been trampled… these little faces that are crumpled by tears to express their sadness and misery. It is not just the men that should change their heart, it is first and foremost about a cruel world.

In 1965, Prince Norodom Sihanouk, Cambodia’s head of state, asserted the nation’s opposition to the U.S.-backed government in South Vietnam by allowing North Vietnamese guerrillas to set up bases within Cambodia’s borders. Pol Pot’s success as a political killer was based on his great skills in deception and manipulation and the help of a handful of trusted and loyal assistants. He relied on his uncanny ability to win his colleagues ‘ trust. He would exploit their gullibility to use them to help him create the bases for a political system with which they would not agree, and then kill them to prevent them from obstructing his hidden political agenda when he decided it was time to move on to take the next step. His personal charm and charisma and his astute manipulation of Stalinist united front tactics made it possible for him to eliminate one potential rival and opponent after another. But even the greatest maestro of murder could not succeed alone on Pol Pot’s scale, and the Secretary of the Communist Party of Kampuchea Central Committee had a few attendants who were crucial to this process. Some were odious patsies who eventually also became his victims, and some were unpredictably crass brutes whose ultimate usefulness was limited. But one docile and more urbane minion upon whose loyalty Pol Pot could always rely was Khieu Samphan.
Before Pol Pot’s Communist Party took power in April 1975, its secret member Khieu Samphan was well-known in Cambodia as an highly-educated economist and politician who was willing to work hard at what he believed in. In any political system Khieu Samphan would have been a good staffer, diligent if somewhat mediocre intellectual who would take seriously his assigned responsibilities. He would always produce the required brief on time, and could always be relied upon to do what his superior told him. But such banality was inexcusably evil in the service of Pol Pot, and it was with him that Khieu Samphan found his historical niche. It was his usefulness as an accomplice in murder rather than his faded economic expertise which made him so highly valuable to Pol Pot. During the brief but bloody course of Pol Pot’s tenure in power, Khieu Samphan was promoted up the ranks of his Party and State apparati to become one of the key accomplices in the political execution machine that Pol Pot created. Khieu Samphan became an ever more important assistant to Pol Pot because he remained steadfastly loyal to his leadership and policies while others who had earlier cooperated with Pol Pot and his Communist Party were detained or killed because they disagreed with or were suspected of disagreeing with what Pol Pot was doing. Khieu Samphan’s political star rose literally on heaps of corpses. He continued to rise in importance as he helped Pol Pot purge other communists who had worked longer and more closely with his boss, but whom Pol Pot came to suspect were sceptical about his murderous revolution . As Pol Pot successively chopped off the hands of other people in his inner circle, the circle grew narrower and narrower and Khieu Samphan more and more important in it until he was Pol Pot’s chief servitor.

Cuba is considering implementing the Swedish example in fighting prostitution by penalizing the clients rather than the sex workers,” Cuban sexologist Mariela Castro said Thursday.

CAMBODIA: Researchers found 87% of young men were having sex with their girlfriends or prostitutes; 10% were having sex with other males. There are 10,000 to 20,000 women and children in prostitution in Phnom Penh, a city of 1 million. Massage parlors and karaoke bars are frequently fronts for prostitution rings.

Prostitution has become a “fixture of urban life” in Cambodia.

Tuol Kok district is Phnom Penh is Cambodia’s most well-known light district. In 1992, the average age of prostituted persons was 18. This dropped to 15 years by April 1993, and a follow-up study in February 1994 suggested that 35% of the persons engaged in prostitution were under the age of 18, according to the Cambodian Women’s Development Association. By March 1995, minors (aged 12 to 17 years old) comprised nearly 31% of prostituted persons in Phnom Penh and 11 other provinces, according to a survey conducted by the Human Rights Vigilance of Cambodia. 35% of prostitutes in Cambodia are under the age of 18.

NOTE: This model of Sweden in combatting prostitution is very effective and should be implmented in the world. But i think it wont work IF it is to be implemented in any countries where the brothels are run by the powerful, esp. Cambodia.

NEC Must be Reformed

Cambodian National Election Law Must be Reformed if it is to guaranttee free and fair election in the future and to have the true leaders to represent our our people who vote for them respectively.

2008 CASE TO BE UNDERSTOOD HOW THE BALLOT COUNT TRICKED TO SERVE THE CPP (Criminal People’s Party).

  1. Cambodian People’s Party recieved 3,492,374 votes= 90 seats ==> 1 seat = 38804 votes.
  2. Sam Rainsy Party recieved 1316714 votes = 26 seats ==> 1 seat=50642 votes.
  3. Human Rights Party recieved 397816 votes = 3 seats ==> 1 seat = 132609 votes.
  4. Norodom Ranariddh Party recieved 337943 votes = 2 seats ==> 1 seat = 168971 votes.
  5. Funcinpec recieved 68909 votes = 1 seat ==> 1 seat = 68909 votes.

NOTE: This is how the CPP wins the election and yet if the seats are to be allocated equatlly accoding to votes recieved, the CPP could get only 71 seats of the 123 seat at the national assembly of the total 6,010,277 votes turnout in 2008.

There arguments raised that the “proportional system used by NEC today was  the formular has agreed since the first national election in 1993. Sowhy  do we need to reform it now?

 The REASON is that the fact then was different from now:

  • The national elecion committee then was indepenedent which could guarantee free and fair election with the international standard.
  •  The seat allocation then and now is still the same -proportional system which then 1 seat equal to 40000 votes as stipulated in the law.

WHY IT NEEDS TO BE REFORMED NOW? REASONS ARE:

  • NEC is not independent
  • The numbers of voters are increased and the seat numbers are still the same -123 seats, which are imbalanced and contradictory to the national election law.
  • The refusal to increase more seats and the proportional seat allocations now, the system that has practically shown negative result to guarantee free and fair election adding to threats, vote-buying, assasination, etc, are unacceptable because these will help to secure the CPP´s status-quo for years to come. We demand to to have a proportional system of “ Modified Form of the Sainte-Laguë Method” in which the core of it is the system that remains intensely proportional, and thus a party which wins approximately 25% of the vote should win approximately 25% of the seats.

NOTE: The flaw of present proportional system is that it favors the winner which legitimately collect the rest votes of the minor parties´s votes to add to its seats.
